Are you aware of the EMIR challenges for Asset Managers?
A common quote from assets managers is:
"Regulation as such would not be a problem, if only one knew how it looks like“.
We have seen that uncertainty regarding the implementation of EMIR leaves a lot of space for interpretation in this area; in particular the constellation of having an asset management company, fund manager and custodian, marks a huge challenge to most. The major challenges are in the following areas:
- Each fund is an own legal entity – making legal and operational on-boarding hard
- Obstacles towards reporting obligation – who reports what?
- Impact of new collateral requirements in the context of asset managers
